By accessing or using HealthUnwired ("Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use our telehealth platform, website, or related services. We serve patients in the United States and the United Kingdom; additional terms may apply based on your jurisdiction.

2. Description of Services

HealthUnwired provides an online platform that connects patients with verified healthcare professionals for video consultations, prescriptions (where clinically appropriate), and follow-up care. Our services are designed to complement, not replace, in-person care. You are responsible for providing accurate information and for decisions made in reliance on consultations.

3. Eligibility and Account

You must be at least 18 years of age (or the age of majority in your jurisdiction) and capable of forming a binding contract to use our services. You must create an account with accurate, complete information and keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Use of the Platform

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You will not:

• Impersonate any person or entity or misrepresent your affiliation.
• Use the Platform for any purpose that is illegal or prohibited.
• Interfere with or disrupt the Platform, servers, or networks.
• Attempt to gain unauthorized access to any systems or other user accounts.
• Share consultation content or prescription details with third parties in violation of applicable law or the doctor's instructions.

5. Consultations and Medical Care

Consultations are provided by independent healthcare professionals. The professional relationship is between you and the treating clinician. We do not practice medicine; we facilitate access to care. Prescriptions and treatment decisions are at the sole discretion of the treating clinician based on your presentation and applicable standards of care. In case of a medical emergency, contact local emergency services immediately.

6. Payments and Refunds

You agree to pay all fees associated with your use of the Platform as displayed at the time of booking. Payment terms, refund eligibility, and cancellation policies will be communicated at the point of purchase. We reserve the right to modify pricing with notice where required by law.

7. Intellectual Property

The Platform, including its design, text, graphics, logos, and software, is owned by HealthUnwired or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

8. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Platform, you consent to such processing.

9. Disclaimers

THE PLATFORM AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE ACCESS. MEDICAL OUTCOMES DEPEND ON MANY FACTORS; WE DO NOT GUARANTEE ANY PARTICULAR RESULT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEALTHUNWIRED AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless HealthUnwired and its affiliates, officers, and employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

12. Changes and Termination

We may modify these Terms at any time. We will post the updated Terms on this page and update the "Last updated" date. Continued use after changes constitutes acceptance. We may suspend or terminate your access to the Platform for breach of these Terms or for any other reason consistent with applicable law.

13. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which HealthUnwired operates, without regard to conflict of law principles. Any dispute shall be resolved in the courts of that jurisdiction, unless otherwise required by mandatory law in your country of residence (e.g., UK consumers may have additional rights).
